Navigating California’s New Indoor Workplace Heat Illness Standards

On June 20th, the Occupational Safety and Health Standards Board approved California Code of Regulations, Title 8, Section 3396, “Heat Illness Prevention in Indoor Places of Employment.” This standard applies to most workplaces where the indoor temperature reaches 82°F, establishing required safety measures to prevent worker exposure to risk of heat illness. The Office of Administrative Law (OAL) has 30 working days to review the proposal. The Standards Board has requested that the regulation then take effect immediately following OAL approval. Note: For outdoor heat illness prevention, refer to Title 8, Section 3395.


Per a recent legal briefing from Fisher Phillips, and due to “the growing number of heat-related worker injuries and fatalities,” OSHA noted that “heat is the leading cause of weather-related deaths in the United States.” OSHA’s new rule aims to build on existing state-level heat standards, such as those in California and several other states. The rule applies to all employers conducting outdoor and indoor work in all general industry, construction, maritime, and agricultural sectors where OSHA has jurisdiction. It excludes short-duration employee exposure to heat, “sedentary” employees, those in indoor job sites kept below 80 degrees, remote workers, emergency response workers who are exempted under the rules, and government employers.
